What is Professional Malpractice?
Professional malpractice or professional negligence is when a professional deviates from the standard of care, or fails to perform the expected duties of their profession.
Just as doctors and nurses are expected to follow medical standards of care when treating patients, other professionals with particular expertise in the services they provide (e.g. accountants, financial advisors, engineers, architects, IT consultants, pharmacists, attorneys etc.) are also required to meet expected standards to ensure no harm is caused to clients.
Carelessness, misleading advice, errors and omissions all fall under professional malpractice. In addition to traditional medical malpractice common professional malpractice claims include dental negligence and negligence of school or daycare staff. In cases where a dentist, teacher or a childcare professional deviates from the standard of care and causes harm to a person, they can be held accountable for their actions.
